1. Who we are

rtacabinetsplus.com (the "Site") is operated by RTA Cabinets Plus ("RTA Cabinets Plus", "we", "us" or "our"), an independently owned online retailer of ready to assemble kitchen cabinets, bathroom vanities and related products. 2. Agreeing to these terms

By using the Site or placing an order, you agree to these Terms of Service, our Shipping Policy, our Refund Policy and our Privacy Policy, which are part of these terms. If you do not agree, do not use the Site. You must be at least 18 years old to place an order.

3. Your account

You are responsible for keeping your account login confidential and for all activity under your account. Information you give us must be accurate and complete. We may refuse service, suspend or close accounts, or cancel orders at our discretion, including where we suspect fraud or misuse.

4. Products, pictures and descriptions

We try to describe and show every product accurately. Colors, grain and finish on a screen will not exactly match the product in your room, and natural wood varies from piece to piece. That is why we sell sample doors, and we strongly recommend ordering one before you order a kitchen. Product dimensions, specifications and availability can change, and we may correct errors at any time.

5. Prices and payment

Prices are in US dollars and are shown on the Site. Freight is quoted at checkout from the delivery address and is not guaranteed until the order is confirmed. Sales tax is added where required. Orders must be paid in full before they are processed. If a price is listed in error, we may cancel the order and refund any payment, even after we have sent an order confirmation.

6. Orders and acceptance

Your order is an offer to buy. A contract forms when we ship the order or otherwise confirm acceptance. We may limit quantities, refuse an order, or cancel all or part of an order, for example when an item is out of stock or discontinued. If we cancel, we refund what you paid for the cancelled items. Trade Pro pricing applies only to approved Trade Pro accounts and only on the account it was granted to.

7. Shipping, delivery and risk of loss

We ship to the continental United States only, not to Alaska, Hawaii, Canada or international addresses. Delivery dates are estimates, not guarantees. Delivery terms, receiving and inspection requirements, storage fees and claim deadlines are set out in our Shipping Policy. Risk of loss passes to you when the order is delivered to the delivery address.

8. Returns, refunds and cancellations

Returns are accepted within 30 days of delivery, unassembled and in the original packaging, with a 20% restocking fee, and you pay return freight. Shipping damage and defects go through our claims process, not returns. Assembled cabinets, trim and accessories, and hoods and vents are not returnable. The full terms are in our Refund Policy. 9. Warranty

Our cabinets and vanities carry the limited warranty published on the Site at /pages/rta-cabinet-warranty, which sets out what is covered, what is excluded, and how to make a warranty claim. Except for that written limited warranty and to the fullest extent the law allows, products are sold "as is", and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow these exclusions, so they may not apply to you.

10. Assembly and installation

You are responsible for confirming that products fit the space they are intended for, and for assembling and installing them correctly, following the assembly instructions and applicable building codes. Inspect every component before assembly. We are not responsible for damage caused by improper assembly, installation, modification, water or misuse.

11. Limitation of liability

To the fullest extent the law allows, RTA Cabinets Plus is not liable for any indirect, incidental, special, consequential or punitive damages, including installation or removal costs, lost profits or delays, arising from the Site or any product. Our total liability for any claim relating to a product or order is limited to the amount you paid for that product.

12. Your use of the Site

You may use the Site only for lawful purposes. You may not copy, scrape or reuse Site content for commercial purposes without our written permission, interfere with the Site's operation, or attempt to gain unauthorized access to it. All text, images, logos and design on the Site belong to RTA Cabinets Plus or its licensors.

13. Third-party services

The Site uses third-party services for payments, shipping, design tools and communication. Their use is governed by their own terms, and we are not responsible for them.

14. Indemnity

You agree to indemnify RTA Cabinets Plus against claims, losses and costs arising from your breach of these terms or your misuse of the Site or the products.

15. Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute arising from these terms, the Site or an order will be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction. Nothing here limits any right you have under consumer protection law that cannot be waived.

16. Text messaging terms

Program. RTA Cabinets Plus sends text messages to customers who opt in, about their inquiry, quotes, kitchen designs, orders, shipping and delivery, claims and account. We do not send marketing text messages under this program.

How you opt in. You opt in by checking the SMS consent box on a form on rtacabinetsplus.com, by texting us first, or by asking us to text you during a phone call. Consent is not a condition of any purchase.

Frequency and cost. Message frequency varies. Message and data rates may apply. Check your mobile plan for details.

Opting out. Reply STOP to any message to stop receiving texts. You will get one confirmation and no further messages unless you opt in again. Reply START to opt back in.

Carriers. Carriers are not liable for delayed or undelivered messages.

Privacy. See our Privacy Policy at rtacabinetsplus.com/policies/privacy-policy. We do not share your mobile number or SMS consent with third parties or affiliates for marketing.

17. Changes to these terms

We may update these terms by posting a new version on the Site. The version in effect when you place an order applies to that order.

18. General

If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it. These terms, together with the policies listed in section 2, are the entire agreement between you and RTA Cabinets Plus about the Site and your orders.
